1. About these terms

These Terms of Service govern your use of the website https://acre.supply and any purchase you make from ACRE Supply.

The website and store are operated by A Creative Endeavour Ltd, trading as ACRE Supply (“ACRE Supply”, “we”, “us” or “our”).

By using this website or placing an order, you agree to these terms. Nothing in these terms limits any rights you have under applicable consumer law.

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order.

2. Products

We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly depending on photography, lighting, manufacturing processes and your screen.

Product measurements are approximate unless stated otherwise. Packaging may differ from images shown on the website.

All products are subject to availability. We may withdraw or change a product before accepting your order.

3. Prices and payment

Prices include VAT where applicable.

Delivery charges and any other applicable costs will be shown before you submit your order.

For international orders, the recipient may be responsible for import duties, taxes and customs charges. These charges are not included unless expressly stated during checkout.

We accept the payment methods shown at checkout. Payment must be authorised before we dispatch an order.

If a product is listed with an obvious pricing or description error, we may cancel the affected order and issue a full refund.

4. Orders and contract formation

Submitting an order is an offer to purchase the selected products.

After checkout, we will send an order acknowledgement. This confirms that we have received your order but does not necessarily mean that we have accepted it.

A binding contract is formed when we send a dispatch confirmation or otherwise confirm that we have accepted the order.

We may decline or cancel an order before acceptance, including where:

• a product is unavailable;

• payment cannot be authorised;

• the price or description contains an obvious error;

• delivery is unavailable to the supplied address;

• we reasonably suspect fraud, misuse or unauthorised resale; or

• the order would breach applicable law.

If we cancel an order after taking payment, we will refund the amount paid.

5. Delivery

We deliver to the locations listed in our Shipping Policy or at checkout.

Estimated delivery times are not guaranteed unless expressly stated. Events outside our reasonable control may cause delays.

Unless another period has been agreed, UK consumer orders will be delivered without undue delay and normally within 30 days after the contract is formed.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an error.

Risk of loss or damage passes to you when the products are delivered to you or a person you nominate. Ownership passes once we have received payment in full.

6. Cancellation and returns

If you are a UK consumer purchasing online, you normally have the right to cancel your order without giving a reason within 14 days after the day you, or a person nominated by you, receives the goods.

To cancel, send a clear statement to supply@acre.studio before the cancellation period expires. Include your name, order number and the products you wish to return.

After notifying us, you must return the products within 14 days to:

Unless the products are faulty, incorrect, or our Returns Policy says otherwise, you are responsible for the direct cost of returning them.

Products should be returned with reasonable care. We may reduce a refund to reflect a loss in value caused by handling beyond what would reasonably be permitted when examining the product in a shop.

Certain products may be excluded from change-of-mind cancellation rights where permitted by law, including:

• personalised products, digital products or made-to-order goods

• sealed goods that are unsuitable for return for health or hygiene reasons once unsealed; and

• other products specifically exempted by applicable law.

Any exclusion will be identified before purchase where relevant.

7. Refunds

When you validly cancel an eligible order, we will refund:

• the price paid for the returned products; and

• the cost of our least expensive standard delivery option, where required by law.

We do not have to refund the additional cost of an enhanced delivery method you selected.

We may withhold the refund until we receive the returned products or you provide evidence that they have been sent back, whichever occurs first.

Refunds will normally be made within 14 days after that point, using the original payment method unless agreed otherwise.

8. Faulty, damaged or incorrect products

We are responsible for providing products that are as described, fit for purpose and of satisfactory quality, as required by law.

If a product arrives faulty, damaged or incorrect, contact [CUSTOMER SERVICE EMAIL] with your order number and, where helpful, photographs of the issue.

Your statutory rights for faulty or misdescribed goods are separate from, and are not limited by, our change-of-mind returns policy.

9. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions.

Unless stated otherwise, discount codes:

• cannot be exchanged for cash;

• cannot be combined;

• apply only during the stated promotional period;

• may exclude particular products or delivery charges; and

• may be withdrawn where they are used improperly or contrary to their conditions.

You may use this website only for lawful personal or commercial browsing and purchasing.

You must not:

• misuse, disrupt or attempt to gain unauthorised access to the website;

• introduce malicious code or harmful material;

• scrape, copy or extract website content using automated means without permission;

• use the website fraudulently;

• interfere with another person’s use of the website; or

• use our content or branding in a misleading or unauthorised manner.

We may suspend or restrict access where reasonably necessary to protect the website, our customers or our business.

“ACRE Supply”, associated marks and visual identities may not be used without permission.

14. Our responsibility

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

• any other liability that cannot lawfully be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable, losses caused by events outside our reasonable control, or business losses incurred by a consumer.

If you use products or this website for business purposes, additional limitations may apply, but nothing excludes liability that cannot legally be excluded.

15. Events outside our control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including transport disruption, industrial action, severe weather, natural disasters, interruption of utilities or communications, supplier failures and government action.

We will take reasonable steps to reduce the effect of such events and resume performance where possible.

16. Changes to these terms

We may update these terms to reflect changes to the store, our practices or applicable law.

The terms in force when your order is accepted will govern that purchase. Material changes will not apply retrospectively unless required by law.

17. Severability and waiver

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

A delay in enforcing a right does not waive that right.

18. Governing law and disputes

These terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom or another country, you retain any mandatory rights and protections available under the laws that apply to you.

Consumers may bring proceedings in the courts permitted by applicable consumer law.
